Droni ed emergenze: quali sfide per il costituzionalismo?

Abstract

I droni sono sempre più spesso utilizzati nei contesti di emergenza di natura tanto politica quanto tecnica. Infatti, al di là dell’uso dei droni nei conflitti armati e nelle operazioni di contrasto al terrorismo, esperienze recenti mostrano che questi sono impiegati sempre più spesso anche nella gestione di altre emergenze, come quella sanitaria, climatica, migratoria e umanitaria. Per quanto i droni offrano grandi opportunità nei contesti emergenziali, il presente contributo mostra che l’uso dei droni solleva notevoli sfide per i principi cardine del costituzionalismo. L’analisi si concentra in particolare sul principio di trasparenza, il principio di eguaglianza, la tutela dei diritti fondamentali e le forme di controllo, facendo riferimento all’esperienza statunitense e a quella europea.
