Abstract

The essay, also taking into consideration the very recent adoption of Regulation (EU) 2024/1689 (Artificial Intelligence Act), proposes a reflection on the devolution of the formation of public will to a programmed and instructed system of data processing and therefore on the repercussions that this choice determines on the exercise of the right to defense by the subject to whom the final measure is addressed.
