The present work analyzes the impact of the use of artificial intelligence systems in the exercise of public functions, with particular attention to the consequences of delegating complex tasks to such tools, even in discretionary proceedings. In this context, it reflects on how decision automation may affect transparency, due process, and human responsibility – key elements for ensuring the legitimacy of administrative actions – as well as the role to be attributed to AI. The paper examines national and European legislation on the matter, as well as the jurisprudential approach in the field, which reflect a growing focus on transparency and accountability – considered essential aspects for the safe and effective adoption of AI in public contexts.
