Abstract

The European Media Freedom Act (EMFA) envisages for the first time a harmonised discipline for the control of concentrations in the media markets. This harmonisation is both substantial and essentially procedural, defining new organisational structures for the authorities in charge and a new system of institutional governance. From a substantive point of view, market plurality is guaranteed by the necessary interconnection between the objectives of “media plurality”, on the one hand, and “editorial independence”, on the other hand, which seems to blur the existing clear distinction, in some national legal frameworks, between the concepts of external and internal pluralism, especially in relation to the digital media and information environment. Finally, the Italian Code of Audio-Visual Media Services (TUSMA) seems to be substantially aligned with EMFA's provisions, and the guidelines already adopted by AGCOM may probably represent a national good practice and, possibly, a reference model for the future adoption of the Commission's orientations for the purposes of the market plurality test required by EMFA.
