Abstract

This contribution, starting from the draft regulation approved by AGCOM following the consultation on age assurance tools initiated in implementation of the so-called “Caivano Decree”, aims to analyze future regulatory and applicative scenarios related to the identification and authentication tools for minors. In particular, it will examine the tools currently provided for by Italian legislation, which establishes specific requirements for user identification, and the intersections of these with the provisions recently outlined in the European regulation known as “eIDAS 2”, which aims to ensure a secure and interoperable digital identity at the European level. The goal is to explore the opportunities and challenges posed by the governance’s choices.
