Documental and Institutional Development. The example of the “Sistema Informativo Integrato” for energy markets

This article concerns the s.-c. Sistema Informativo Integrato (SII), foreseen by Article 1-bis of Law Decree 105/2010, in order to manage national energy markets data flows, based on a data base of the delivery points and other data that identify the final clients. The analysis is focused on the regulation of this data flows, set by the Italian regulation authority, and it aims to, on one hand, with reference to energy law, highlight the fundamental role played by the SII: the SII is an essential facility – like other energy network infrastructures – and influences the morphology of contractual relationships that constitute the energy markets (in particular, retail markets). On the other hand, and in light of the theory of law, this paper argues that the SII serves as an example of how the technology of documentation, used in order to establish legal practices, can influence the regulation (and the development of regulation) of such practices.
