Legality, algorithms and corruption: can AI techniques be used in and for the corruption prevention system?

Abstract

The article aims to consider what could be the potential opportunities and risks related to the use of artificial intelligence (AI) techniques in the Italian system of corruption prevention. In particular, it considers the risk management process, as a crucial moment for the adoption of administrative measures for the corruption prevention. The use of AI techniques could improve these phases, speed up the procedure and guarantee greater impartiality in the choice of measures. At the same time, however, the adoption of partial or total AI techniques would bring with it both certain complicated elements and a significant downsizing of the current system. An additional consideration is directed to those areas or instruments that, although not to be considered as strictly internal to the prevention system, could contribute to the preventive cause itself. The final section discusses the problematic aspects that the application of AI in the field of prevention could entail in terms of participation and legality.
