Abstract

The Language of Law, the Language of Artificial Intelligence. A first reflection
This article examines the relationship between the language of law and that of Artificial Intelligence (AI) within the context of the digital society, a subject of increasing relevance in the field of democratic constitutionalism. It underscores the fact that the introduction of digital technologies is gradually creating a growing divide between these two languages, which, although initially difficult to reconcile, are crucial for ensuring the proper exercise of fundamental rights within the digital ecosystem. The analysis is grounded in the premise that the social transformation brought about by AI has significant implications for language, raising pertinent questions regarding how this new technology will impact legal language and vice versa. The article, therefore, addresses the necessity of fostering dialogue between the humanistic-literary culture and the scientific-technical culture, emphasizing that effective communication is indispensable for the proper functioning of law in the digital era. Lastly, the author advocates for the use of generative Artificial Intelligence, particularly Large Language Models (LLMs), as a means to facilitate communication between these two realms, thereby enhancing both the understanding of legal concepts and the transparency of AI decision-making within the legal domain, while also highlighting the importance of promoting and safeguarding the Italian language.
